What if plaintiff does not comply with discovery?

It is within the judge's discretion to dismiss a case for failing to comply with discovery, but that is an extreme measure and usually does not happen. Instead, your lawyer will probably file a motion to compel. The judge will give the other side a new deadline comply. If they do not, he could impose sanctions, and in extreme measures dismiss the case.
